The EPA and the U.S. Army Corps of Engineers finalized the Clean Water Rule to clearly protect the wetlands and streams that form the foundation of the nation’s water resources. The Clean Water Rule ensures that waters protected under the Clean Water Act are more precisely defined and more predictably determined. The rule took effect at the end of August 2015, and 31 states, numerous industry groups and some environmental nonprofits are now challenging it in courts across the country. On October 9, 2015, the U.S. Court of Appeals for the Sixth Circuit stayed the Clean Water Rule nationwide pending further action of the court. EPA and the Department of the Army are fully complying with the stay. Please join NAEP as we review the litigation against the Clean Water Rule and arguments posed by states, businesses and industries. Our speaker from the USACE will specifically address how environmental practitioners should address permitting issues and field studies in the interim.
